Information We Collect
We collect information about you so we can continue to provide and improve our Services to you and other users of the Services. The information collected may include items such as your name, e-mail address, mailing address, phone number, facsimile number, financial information, location data (shared either via a mobile device or browser), credit card information, financial institution and bank account information, as well as other information that may or may not specifically identify you. The information collected in connection with the Services may be stored at or on servers, computers, or other media located in the United States.
Depending on your relationship with HALED, the Information HALED collects may constitute Protected Health Information (“PHI”) pursuant to the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). Under such circumstances, HALED will treat your PHI in accordance with applicable law and its policies and procedures in effect from time to time.
We may obtain personal and non-personal information about you from third-party sources. This information may be utilized, analyzed, and/or compared with information that we have collected from you or that you have submitted in connection with your access to or use of the Services. Such third parties may include but are not limited to Google and one or more third party providers associated with the Services, such as laboratories, medical spas, health care organizations, or medical professionals (including but not limited to those acting as mobile examiners) (collectively, “Medical Organizations”). If HALED obtains information from third-party sources, HALED takes reasonable measures to ensure the third parties lawfully obtained and provided the information to us. If the third parties unlawfully obtained and/or provided the information to us despite our reasonable measures to ensure the third parties complied with all legal requirements in obtaining and providing the information to us, you understand, agree, and acknowledge that your sole legal remedy is against the third party that engaged in the unlawful activity and that you will not assert any cause of action, claim or demand against us.
Information Collection Technology (Web Beacons and Cookies)
We may use various technologies to collect information from your electronic device about your activities in accessing and using the Services. We may collect and store non-personally identifying information through cookies, log files, clear gifs (commonly known as “web beacons”), and third parties to profile user activity and preferences. Technical and specification information about your browser and computer is automatically collected when you use or visit the Site or the App. This information may include your Internet Protocol (“IP”) address, your browser type, operating system, access time(s), the content of previously accepted “cookies” from us, and the website address that referred you to the Site or the App.
A cookie is data stored on your computer that tracks non-personal information about you. When you access or use the Services, we may assign your computer one or more cookies that enable us to improve the quality of the Services and to personalize your experience. Cookies allow us to automatically collect information about your activity on the Site or the App, such as the content you access, the links you click, and other activity you conduct while accessing or using the Services. You may choose to modify your web browser’s setting to disable cookies or limit their use. If you choose to disable or limit cookies, you are still able to access the Site and the App, but you may be unable to use all of the features of all Services. The Site and the App may contain web beacons (also known as “clear gifs”) or similar technologies that gather non-personally identifiable information about your use of the Services. Such technology may also be contained in e-mail messages or newsletters from us that allow us to determine whether messages have been accessed. The purpose of our use of this technology is so that we may analyze the effectiveness of our marketing efforts, the quality of the Site and the App, and the Services we provide.

To enhance security and promote operational efficiency, the Services utilize the resources of reputable hosting facilities that are controlled by third parties. HALED is unable to provide any guarantees or warranties about these third parties’ retention or usage of your information.
Information Use and Sharing
We may use and share your information for any legally permissible purpose. We may match, use, and share any of the information we collect from you to any personally identifiable information we obtain through third parties. Examples of some ways we may use or share information that we collect about you include:
- providing you with the Services, which may include such products or services that may refer to certain conditions that you may disclose to us or that we may learn from third parties (including Medical Organizations);
- providing you with customized content and services, including such goods or services that may assist you in interpreting your laboratory results and/or that may provide treatment options;
- providing customer support;
- communicating with you by e-mail, United States mail, telephone, text message, and/or mobile devices about products or services that may be of interest to you either from us, any affiliates, sponsors or other third parties;
- meeting our obligations to comply with applicable law;
- working with our advertising partners;
- working with researchers;
- enforcing the Terms of Service or any other of our terms and conditions, or otherwise managing our business; and
- performing functions as otherwise described to you at the time of collection.
In order to perform certain services on your behalf, we may publish certain non-medical information that you provide. You agree that any testimonial feedback or other comments provided by you to HALED becomes the sole and exclusive property of HALED and that such information may be used by HALED for any legally permissible purpose, including but not limited to marketing and advertising the Services and any other HALED services and products.
From time to time, we may establish a business relationship with other businesses (besides or in addition to the Medical Organizations described above) that we believe to be trustworthy and have privacy practices consistent with ours. For example, we may contract with such other businesses to provide paramedical services or certain other services, such as hosting and maintenance, payment processing, data storage and management, marketing and promotions and customer research/analytics. We only provide such other businesses with the information necessary for them to perform these services on our behalf, and each such business must agree to use reasonable security procedures and practices appropriate to the nature of the information involved, in order to protect your personal information from unauthorized access, use, or disclosure.
Communications From Us
With your consent, we may send you marketing emails and text messages, such as newsletters, offers, updates, and promotions. Unless you opt out of certain communication features, we may use your information to communicate with you, such as through e-mail, newsletters, and telephone. You may opt out and/or unsubscribe to communications from HALED at any time. See the “Opt-Out Provisions and Updating Your Information” section below for applicable contact information and directions. If you opt out, we may still send you non-marketing emails, text messages, or other communications that include transactional information about your accounts and our business dealings with you.
Our Advertising Partners
To help serve our users better and provide a better user experience, we may share your information with one or more of our third-party advertising partners. We only share this information with such advertising partners with your permission, so if you do not want us to share your personal information with third-party advertisers, you may opt-out of targeted advertisements by going to your settings and selecting “opt out.” We take reasonable steps to try to provide users with targeted offerings from advertisers that may aid you, such as how to read your laboratory results, what treatment options may exist for your condition(s), and where to find a medical provider who may be able to provide you with additional care.
Your Information Will Not Be Sold
We will not sell any information you submit to us to any other third party without prior written notice to you and an opportunity to opt-out, provided that we are permitted to sell your information if all or substantially all of our assets are sold or as part of a merger or acquisition or other business combination transaction.
Legal Process and Investigation Issues
From time to time, HALED may be required to respond to a subpoena, a court order or similar investigative demand from law enforcement, a government agency, or a private litigant. HALED reserves all rights to defend, within its sole discretion, against such legal requests, demands, and claims. For instance, HALED may raise or waive legal objections or rights. HALED also reserves the right to disclose your information, as allowed by applicable law, when we believe it is reasonably appropriate based on the situation. Such disclosure may occur, but is not limited to, disclosing your information in connection with efforts (i) to investigate, prevent, or commence other actions regarding suspected illegal activity or other wrongdoing; (ii) to protect or defend the rights, property or safety of our company, our users, our employees, or others; (iii) to comply with applicable law or cooperate with law enforcement; or (iv) to enforce the Terms of Service or other agreements or policies.
Notice about Social Security Numbers
We take steps not to collect social security numbers of users unless a Service requested by the user requires it. However, if we come into possession of users’ social security numbers or collect such information in the future, the information will be treated confidentially and not shared with third parties unless allowed by law. Additionally, we will take reasonable steps to limit the access to the social security numbers and take legally required steps to secure transmission of data containing any such social security numbers.
Third-Party Privacy Policies May Be Applicable
The Site and the App may contain links to other websites. HALED disclaims any responsibility for the privacy practices (and any acts or omissions under such privacy practices) of third parties that may have links to or from our website, or any framed content on our website. We encourage you to review the privacy policies/statements of every website that you visit that collects personally identifiable information. If you are concerned about the handling of your information by these third parties, we recommend that you do not click on links to their websites.
DO NOT TRACK Requests
In some states, users may be entitled to know how we respond to “Do Not Track” browser settings. If you are using the “Do Not Track” option in your browser, we will provide you with an option to either accept cookies or reject tracking cookies. If you reject cookies, the Services may not work as intended and you will not receive any tracking cookies (although you will receive a cookie that allows us to maintain your preference of not wanting to accept tracking cookies). If you accept cookies, the Services should work as anticipated.
Opt-Out Provisions and Updating Your Information
We value our users’ privacy and provide them with the option to “opt-out” of having their information used for purposes not directly related to the Services. The opt-out option is available at the time you sign up for your user account with us. If you wish to change your opt-out preference or update your information after you initially sign up for your user account, you can opt-out by any of the following means:

- E-mail a request to opt-out to firstname.lastname@example.org.
Your request will generally be responded to within five business days if your inquiry is via e-mail, or 30 days if your inquiry is via United States mail.
Please note that changing your opt-out preference will only affect future activities or communications from us. In other words, if we already provided your information to a third-party before you changed your opt-out preferences, you will need to contact the third-party directly. To opt-out of communications from our third-party business partners, if any, please contact them directly.
Information Retention and Security
We may store your information for more than one year from the time of initial submission, as well as automated personal information we collect about you. However, if we obtain or collect your social security number or credit card number, that information will only be stored for a limited time pursuant to your authorization unless the law requires otherwise.
We take reasonable security measures to protect users’ information against unauthorized access, loss, alteration, or destruction. These measures include encryption and physical security measures to guard against unauthorized access to systems where we store personal information, and the usage of reputable third-party vendors. Despite these reasonable measures, we cannot guarantee our security measures are impenetrable. Therefore, although we take reasonable steps to secure your information, we cannot and do not promise or warrant that your information will always remain secure.
The safety and security of your information also depends on you. Where we have given you (or you have chosen) a password for access to your user account, you are responsible for keeping that password confidential and taking other reasonable steps to prevent others from gaining unauthorized access to your user account.

Where we collect sensitive Personal Information from you, we will only do so where we have obtained your prior express consent, if required by.
In certain situations, clients of HALED may dictate how their personal information is used, stored, and processed. If you are a client, you may provide written instructions to HALED about how you wish for your personal information to be treated.
